What Steps Must Be Taken To Relocate With A Child?

 

Effective October 1, 2008, if the custodial parent intends to relocate they must file a Notice of Relocation pursuant to Florida Statute § 61.13001.  The non-custodial parent then has thirty (30) days, from the date of service, to file a written objection to the Notice of Relocation.  The objection must be filed with the original court of jurisdiction, and served upon the parent attempting to relocate.  At that time, the Family Law Court will become involved in the case.  If an agreement cannot be reached, then there will be a hearing wherein the Family Law Judge will make a determination as to whether or not the relocation is in the best interests of the child.
